1. Introduction

These Terms & Conditions (the "Terms") govern your access to and use of the services provided by Mercato Brokers Ltd ("Mercato Brokers", "we", "us", "our"), a company incorporated in the Republic of Mauritius with registered office at 18 Bank Street, Ebene, Mauritius, and licensed by the Financial Services Commission of Mauritius (the "FSC") as an SEC-2.1B Investment Dealer (Full Service Dealer excluding Underwriting). By opening an account, using our website mercatobrokers.com, or accessing any of our trading platforms, you accept these Terms in full and agree to comply with all applicable laws and regulations.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) and legally capable of entering into a binding contract. You represent that trading leveraged over-the-counter derivative products is not prohibited by the laws of your country of residence and that you have not been declared bankrupt or subject to any equivalent insolvency proceeding.

3. Account Opening & KYC

All applicants are subject to identity verification, address verification, and Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) checks. You must provide accurate, current and complete information during the application process and update your information promptly if it changes. We may refuse, suspend or terminate any application or account without providing reasons where permitted by law.

4. Services

Mercato Brokers provides execution-only services in spot foreign exchange, contracts for difference (CFDs) on indices, commodities, precious metals, energies, shares and cryptocurrencies, and any other instruments listed in the trading platform from time to time. We do not provide investment, tax or legal advice. Any market commentary, research, analysis, education or third-party content made available through our channels is for informational purposes only and does not constitute a recommendation or solicitation to trade.

5. Client Funds

Client funds are held in segregated bank accounts with reputable banking partners, separated from Mercato Brokers' own operating funds, and are used solely to support the client's trading activity. Client funds are not used for our own operations and are not lent to third parties.

6. Fees & Charges

Spreads, commissions, financing rates and non-trading fees (such as inactivity fees, withdrawal fees where applicable, and currency-conversion charges) are published on our website and within the trading platform. Raw accounts are charged a commission of $5 per lot per side; Professional accounts $3 per lot per side. All accounts are swap-free by default. We reserve the right to amend our fee schedule with reasonable prior notice.

7. Leverage & Margin

Leverage of up to 1:1000 is available across accounts and instruments, subject to margin rules, instrument-level caps and applicable regulatory limits in your jurisdiction. You are responsible for maintaining sufficient margin at all times. Positions may be automatically closed if margin falls below the stop-out level.

8. Risk

Trading forex and CFDs is highly speculative, carries a high level of risk, and is not suitable for every investor. The use of leverage can work against you as well as for you and may result in the loss of all invested capital. Past performance is not indicative of future results. Please read the Risk Disclosure carefully before trading.

9. Prohibited Conduct

You must not engage in market abuse, price manipulation, latency arbitrage, abuse of pricing errors, use of unauthorised third-party arbitrage systems, or any activity that circumvents fair execution. We may void trades, close positions, or terminate accounts found to be engaged in such conduct.

10. Termination

Either party may terminate the client relationship at any time by written notice. Termination does not affect obligations arising from open positions, outstanding settlements or accrued fees. Upon termination we will return the remaining balance to a bank account in your name subject to KYC and AML verification.

11. Limitation of Liability

To the maximum extent permitted by law, Mercato Brokers is not liable for any indirect, incidental, consequential, special or punitive damages, or for loss of profits, revenue, data or goodwill arising out of or in connection with your use of our services.

12. Governing Law

These Terms are governed by the laws of the Republic of Mauritius. Disputes are subject to the exclusive jurisdiction of the courts of Mauritius, without prejudice to any mandatory consumer-protection rules that may apply in your country of residence.

13. Amendments

We may amend these Terms at any time by publishing an updated version on our website. Amendments take effect fifteen (15) calendar days after publication unless a shorter period is required by law or regulation.

Risk Warning. Trading forex and CFDs carries a high level of risk and may not be suitable for all investors. Leverage of up to 1:1000 can work against you as well as for you. You could sustain a loss of some or all of your invested capital and should not invest money you cannot afford to lose.

Jurisdictional Restrictions. Mercato Brokers does not offer services to residents of jurisdictions where such offering would be contrary to local law or regulation, including but not limited to the United States, Canada, Iran, North Korea, Syria, Cuba and any sanctioned territories.
